Terms of sale

1. What these terms govern

These terms govern the online sale, on pathflow.it, of the PathFlow devices and of the PathFlow service included with them. Use of the app and of the web platform is also subject to the Terms of Service. We deliver only in Italy. If you buy as a consumer, the protections of the Italian Consumer Code (Legislative Decree 206/2005) also apply, and these terms never reduce them.

2. The products and the service included

• Tracker with starter block, €169: 4G GPS tracker to be wired to the vehicle, with the SIM already inside, the relay for the starter block and 12 months of service. The starter block prevents the vehicle from being started; it never stops an engine that is already running.
• OBD tracker, €169: 4G GPS tracker that plugs into the vehicle's OBD port, with the SIM already inside and 12 months of service. The data read from the vehicle (fuel, kilometres, faults) depends on its model and is not available on every vehicle.
• 4G 2K dashcam with our SIM, €220: dashcam with a 128 GB memory card, an OBD power cable, an adhesive mount, a SIM with 10 GB of data a month and 12 months of service.
• 4G 2K dashcam with the customer's SIM, €179: as above but without a SIM; a data SIM of the customer's with at least 10 GB a month is needed.

The service includes the PathFlow app for iPhone and Android, the web platform app.pathflow.it and, when the SIM is ours, the data traffic. The 12 months start when the device is activated on your account. Product photos are for illustration.

3. Prices

Prices are in euro and final: the sale is without VAT because the seller applies the Italian flat-rate scheme (regime forfettario, Art. 1, paragraphs 54-89, Law 190/2014). Delivery in Italy is free. Installation in the province of Turin, when you choose it, costs €100 per vehicle and is shown separately in the order.

4. After the first year

• Trackers: €59 a year per device, or €10 a month.
• Dashcam with our SIM: €12 a month or €129 a year, SIM and 10 GB a month included.
• Dashcam with the customer's SIM: €59 a year.

Before the expiry we let you know and you choose whether to renew, online from the platform or in our shop; renewal is automatic only if you turn it on in the platform. If you do not renew, the device is suspended (position, history and alerts are no longer visible) until you renew, subject to section 5.

5. 24-month commitment of the dashcam with our SIM

The dashcam's SIM binds us to the mobile operator for 24 months. For this reason whoever chooses the dashcam with our SIM commits to keep the service for at least 24 months from activation: the first year is included in the price, the second is paid as shown in section 4. If you stop the service before the end of the 24 months you owe €50, which is what we pay the operator. This commitment is approved with a dedicated box before payment (Articles 1341 and 1342 of the Italian Civil Code) and does not apply if you exercise the right of withdrawal within 14 days (section 9). The SIM remains our property and is deactivated at the end of the service.

6. How to buy

Choose the device, the quantity (up to 5: for more vehicles there is the quote) and the options, accept these terms and go on to Stripe's payment page, where you enter address, phone and card details. The contract is concluded when the payment succeeds: we show you the order number and immediately send you a confirmation email with the summary and the main terms. We keep the order and, if you ask us, send you a copy.

While online sales of a product are not active, under the product you find «Contattaci» (contact us): you leave us your details and we answer with the order summary and how to pay. These terms apply in that case too, including the right of withdrawal.

7. Payment and invoice

You pay online by credit, debit or prepaid card, also with Apple Pay or Google Pay, through Stripe. Card details are handled by Stripe: we neither see nor keep them. If you need an invoice, choose «Voglio la fattura» in the order and leave your details, as a private person or as a company.

8. Delivery and installation

We prepare and configure the device and hand it to the courier within 2 working days of payment; it usually arrives in 1–2 working days. We email you the tracking number. In any case delivery takes place within 30 days of the order. The risk of loss or damage passes to you when you receive the parcel. If a product were not available we would let you know at once and refund you in full or, if you prefer, you wait for it.

The tracker with starter block must be wired to the vehicle by an installer. You can have it fitted by your own auto electrician, with the instructions in the box, or choose installation in the province of Turin at €100 per vehicle, done by our auto electrician on the day and at the place agreed with you: in that case we call you for the appointment and the installer brings the device. We are not liable for damage caused by an installation made by others.

9. Right of withdrawal (14 days)

If you are a consumer you may withdraw from the contract without giving any reason within 14 days of the day you receive the device. To do so, send us a clear statement by email to info@pathflow.it, by PEC to europea.lab@pec.it or by post, also using the form below: it is enough that your communication is sent within the 14 days.

The device must be sent back, complete and undamaged, to EUROPEA LAB, Via Ala di Stura 38/D, 10147 Torino, Italy, within 14 days of your communication; the cost of returning it is borne by you. We refund everything you paid, with the same means of payment, within 14 days of the day we receive your communication; we may withhold the refund until we have received the device or proof that you have sent it. You are only liable for any loss of value resulting from handling beyond what is necessary to try it. With the withdrawal the service and the SIM are deactivated and you owe nothing for the commitment of section 5.

If you chose installation and asked us to carry it out before the 14 days are over, in case of withdrawal the installation already carried out is not refunded (Art. 59(a) of the Consumer Code) and its removal is at your expense.

The right of withdrawal belongs to consumers, that is to those who buy for purposes outside their trade or profession. Those buying with a VAT number can still write to us within 14 days: we assess case by case.

10. Guarantee

For consumers the legal guarantee of conformity applies for 2 years from delivery (Articles 128 ff. of the Consumer Code): if the device has a defect write to supporto@pathflow.it and we repair or replace it free of charge; if that is not possible you are entitled to a price reduction or to terminate the contract. For buyers with a VAT number the guarantee lasts 12 months from delivery (Articles 1490 ff. of the Italian Civil Code). The guarantee does not cover damage caused by accidents, tampering, faulty installation by others, water or improper use.

11. Support and complaints

For support write to supporto@pathflow.it (Monday to Friday, 9:00–18:00); for complaints to info@pathflow.it. We answer within one working day.

12. Personal data

We use the order data to carry it out, deliver it, invoice it and comply with the law, as explained in the privacy policy.

13. Applicable law and jurisdiction

The contract is governed by Italian law. For disputes with a consumer, the court of the place where the consumer lives has jurisdiction; in other cases, the Court of Turin. Consumers may also turn to an alternative dispute resolution (ADR) body.
